A lawsuit has been filed against Indianapolis police by Dailen Brewer alleging that an officer’s own body-camera video disproves her claim that he pointed a revolver at her, leading to an attempted-murder accusation and four days in jail.
Brewer, 18, filed the federal complaint on July 20 against Indianapolis Metropolitan Police Department Sgt. Robyn Frazier and the City of Indianapolis alleging false arrest, fabricated evidence, malicious prosecution, false imprisonment and defamation, and seeks compensatory and punitive damages.
The encounter began April 12 at the city’s Riverside Park. According to the complaint, Brewer drove into the park with a passenger and firearms he lawfully possessed. It says two IMPD vehicles were near the entrance but were not positioned to show that the park was closed or blocked.
Frazier followed Brewer to a parking space, approached his car and opened the driver’s door, the filing says. Her body-worn camera allegedly showed Brewer with his hands raised while the firearms remained on the floor, including one between his legs.
The complaint says the car began rolling because it was still in gear as Frazier tried to remove Brewer. When he reached to put the vehicle in park, she drew her firearm. Brewer stopped moving and was arrested.
Frazier’s probable-cause affidavit said Brewer raised a revolver and pointed the barrel toward her. The lawsuit alleges that account was fabricated and that the footage showed Brewer never touched a firearm in Frazier’s presence.
Frazier recommended charges including Level 1 felony attempted murder, resisting law enforcement, intimidation and pointing a firearm. Brewer was unable to post bond and remained jailed until April 16, when a Marion County deputy prosecutor dismissed all charges after finding that the footage did not match the affidavit.
Brewer also alleges Indianapolis continued publishing statements that portrayed him as someone who tried to shoot an officer after the charges were dismissed. The complaint says those statements remained publicly available as of July 15 and damaged his reputation and employment opportunities.
Brewer’s lawsuit is a federal civil rights case claiming violations of Brewer’s Fourth and 14th Amendment rights, along with several Indiana-law claims. As of July 29, 2026, the Indianapolis Metropolitan Police Department still has a post up on Facebook with the officer’s version of events.
